Terms & Conditions

Article 1 – Applicability

1.1. These terms apply to every offer from Firmo and to every distance agreement concluded between Firmo and consumers or business clients.
1.2. Deviations are only valid if confirmed in writing.

Article 2 – Offer and Agreement

2.1. The offer contains a complete and accurate description of the products offered. Obvious mistakes or errors do not bind Firmo.
2.2. The agreement is established when the order is placed through the webshop and Firmo has sent the order confirmation.

Article 3 – Prices and Payment

3.1. All prices are in euros, including VAT and excluding shipping costs, unless stated otherwise.
3.2. Payment takes place via the available payment methods at the moment of ordering.
3.3. Discounts and promotions cannot be combined unless stated otherwise.

Article 4 – Delivery and Execution

4.1. Firmo aims to ship within 1–3 business days after order confirmation, unless otherwise stated on the product page.
4.2. Delivery times are indicative; exceeding them does not entitle the customer to compensation.
4.3. The risk of damage or loss remains with Firmo until the order has been delivered to the customer.

Article 5 – Right of Withdrawal (consumers)

5.1. Consumers have a 14-day cooling-off period after receipt to withdraw without giving any reason.
5.2. After withdrawal, the consumer has another 14 days to return the product.
5.3. The consumer must handle the product carefully and only use it to the extent necessary to establish the nature, characteristics, and functioning.
5.4. Exceptions: custom-made or personalized products are excluded from withdrawal unless defective or non-conforming.

Article 6 – Returns and Refunds

6.1. Returns must be requested via Ekbedrijf@gmail.com stating the order number.
6.2. Return shipping costs are borne by the customer, unless agreed otherwise.
6.3. In case of a full return, the purchase price including standard outbound shipping costs will be refunded. Extra chosen delivery options (e.g., evening delivery) are not reimbursed.
6.4. Refunds will be made within 14 days after withdrawal, but may be delayed until Firmo has received the product back or the customer has provided proof of return shipment.

Article 7 – Conformity and Warranty

7.1. The product must meet reasonable expectations and legal conformity.
7.2. Products are handmade from rail steel; natural variations in color/texture are inherent and do not constitute a defect.
7.3. In case of a defect, the customer must notify us as soon as possible; Firmo will repair, replace, or reimburse where reasonable.

Article 8 – Liability

8.1. Firmo is not liable for indirect or consequential damages.
8.2. Liability is limited to the amount of the relevant order, unless caused by intent or gross negligence.

Article 9 – Force Majeure

9.1. In case of force majeure (e.g. disruptions, transport issues, illness, government measures), Firmo may suspend performance or terminate the agreement without liability.

Article 10 – Intellectual Property

10.1. All content, designs, and images on the website are owned by Firmo or its licensors and may not be used without permission.

Article 11 – Complaints and Disputes

11.1. Complaints can be submitted via Ekbedrijf@gmail.com; Firmo will respond within 14 days.
11.2. Dutch law applies to all agreements.
